Terms of Service

Summary: Wispy is provided strictly on an "AS-IS" and "AS-AVAILABLE" basis. By using Wispy, you agree not to use the service for any illegal activities, spam, or scams, and acknowledge that the operator is not liable for any damages or inaccuracies arising from AI processing.

1. Acceptance of Terms

By adding, configuring, or interacting with Wispy (@wispy_assistant_bot) on Telegram or accessing its companion Mini App, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must discontinue using the service immediately.

2. Description of Service

Wispy is a personal chat assistant that operates within the Telegram ecosystem. Its primary capabilities include real-time voice and video note transcription, keyword and AI-powered preset responses, customer note management, and multi-tenant conversational automation.

3. "As-Is" and "As-Available" Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The service will be uninterrupted, timely, secure, or completely error-free.
  • Voice transcription or AI intent classification outputs will be 100% accurate or reliable.
  • Third-party platforms (Telegram Bot API, Groq Cloud API) will maintain 100% uptime.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATOR, DEVELOPERS, OR CONTRIBUTORS OF WISPY (INCLUDING EVGENII ZINNER AND AFFILIATED ENTITIES) BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, BUSINESS REPUTATION, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR IN CONNECTION WITH:

  • Your access to, use of, or inability to access or use the service;
  • Any automated response, transcription error, or message sent by the bot on your behalf;
  • Any unauthorized access, use, or alteration of your transmissions or content;
  • Actions or content of any third party on the service.

5. Prohibited Use & Acceptable Conduct

You agree not to use the service, directly or indirectly, for any unlawful or malicious purpose. Prohibited activities strictly include, but are not limited to:

  • Engaging in, facilitating, or promoting any illegal activity under local, national, or international law;
  • Sending unsolicited bulk messages (spam), chain letters, or commercial solicitations without consent;
  • Operating fraudulent schemes, phishing attempts, impersonation, or financial deception;
  • Distributing viruses, trojans, worms, malicious scripts, or denial-of-service payloads;
  • Harassing, threatening, stalking, or defaming individuals or groups;
  • Violating Telegram's Terms of Service or Privacy Policy.

6. Data Processing Role & Client Data Authorization

With respect to personal data of third parties (your clients, contacts, and chat interlocutors) processed through the service, the User acts as the Data Controller, and Wispy acts strictly as a Data Processor carrying out automated processing on the Controller's instructions solely to deliver the service functionality.

By connecting and using Wispy, the User represents and warrants that:

  • You possess a valid lawful basis to collect and transmit third-party data to Wispy;
  • Where required by applicable law, you have duly informed chat participants and obtained explicit consent for automated processing, speech recognition, and AI analysis;
  • You will not use the service for unlawful surveillance or illicit collection of confidential data;
  • Wispy and its developer assume no liability for the User's failure to satisfy legal disclosure or consent mandates.

Wispy agrees to maintain confidentiality and implement appropriate technical and organizational measures to safeguard processed data.

7. Cross-Border Data Transfer & Server Localization

Wispy's technical infrastructure, AI models, and cloud computation providers (including Groq Cloud, Cloudflare, and associated databases) are hosted on international servers (including within the United States and the European Union).

By using Wispy, you:

  • Explicitly consent to the cross-border transfer of data to foreign cloud servers to the extent necessary for operating the bot and Mini App;
  • Acknowledge that you have independently verified that your use of cloud-hosted infrastructure complies with your domestic data residency and localization regulations;
  • Agree to hold harmless and indemnify the developer against any claims, regulatory penalties, or compliance liabilities resulting from international data transmission.

8. Termination & Suspension

We reserve the right to suspend or terminate your access to Wispy at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Service.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Continued use of the service following the posting of any changes constitutes acceptance of those changes.
